Welcome to FIFE.

These Terms & Conditions ("Terms") govern your use of the FIFE website and your purchase of products and services from FIFE CLOTHING INC., operating as "FIFE" ("FIFE," "we," "us," or "our").

By accessing our website, submitting a Trip Collection request, approving artwork, placing an order, or purchasing products or services from FIFE, you agree to these Terms.

If you do not agree with these Terms, please do not use our services or place an order.

About FIFE

FIFE creates limited-edition apparel collections designed around golf trips, groups, destinations and experiences.

FIFE Trip Collections may incorporate third-party base garments manufactured by companies such as Nike, Under Armour, Cutter & Buck or other manufacturers.

Unless expressly stated otherwise, FIFE is an independent business and is not sponsored by, affiliated with, endorsed by, or engaged in an official collaboration with any third-party base-garment manufacturer.

References to third-party trademarks or product names are intended to identify the applicable base garment.

Trip Collections

A FIFE Trip Collection may include:

• selection of a base garment;
• custom artwork or identity development;
• trip name;
• destination;
• year;
• Trip Number;
• group or player information;
• slogans or other approved wording;
• artwork placement;
• embroidery, printing or other decoration; and
• other customization agreed to by FIFE and the customer.

The exact products and services included in an order will be identified in the applicable quote, order confirmation, invoice, artwork approval or other written order documentation.

Trip Organizer

The individual submitting an order on behalf of a group will normally be considered the Trip Organizer.

The Trip Organizer is responsible for providing FIFE with accurate information relating to the group's order, including quantities, sizes, names, personalization and other requested information.

Unless FIFE agrees otherwise in writing, FIFE may rely on instructions and approvals provided by the Trip Organizer as authorization on behalf of the order.

Quotes and Pricing

Prices displayed on our website, if any, may be starting prices or estimates unless specifically identified as final.

The final price of a Trip Collection may depend on factors including:

• selected base garment;
• number of garments;
• number and type of decorations;
• artwork complexity;
• personalization;
• shipping;
• taxes;
• rush production; and
• other requested services.

A quote does not constitute an accepted order until the requirements specified by FIFE for acceptance have been completed. Applicable taxes will be charged as required by law.

Payment

Payment requirements will be communicated before production.

FIFE may require a deposit, design fee, partial payment or full payment before beginning design work, purchasing garments or beginning production.

Unless otherwise agreed in writing, production will not begin until all required approvals and payments have been received.

Base Garment Availability

Base garments are manufactured and supplied by third parties.

Product availability, colours, sizing and inventory may therefore change without notice.

Submitting a Trip Collection request does not guarantee that a particular garment, colour or size will remain available.

If a selected garment becomes unavailable before production, FIFE may contact the Trip Organizer to discuss an alternative, revised timeline, refund of amounts attributable to unavailable products, or another reasonable solution.

FIFE will not intentionally substitute a materially different base garment without customer approval.

Product Variations

Actual products may vary slightly from digital mockups due to differences in screens, manufacturing, garment construction and decoration processes.

Reasonable variations may occur in:

• colour;
• embroidery;
• print positioning;
• dimensions;
• garment construction; and
• placement relative to seams or other garment features.

Digital mockups are intended to communicate the design and placement and are not necessarily exact photographic representations of the finished garment.

FIFE / Document 08

Sizing

Customers are responsible for reviewing available sizing information and submitting correct sizes.

Sizing may differ between manufacturers and garment models.

Once customized products enter production, size changes may not be possible.

Unless required by applicable law or otherwise stated by FIFE, a correctly produced personalized garment generally cannot be exchanged solely because the customer selected an incorrect size.

Artwork Approval

Custom production will be governed by the FIFE Artwork Approval Agreement below.

The Trip Organizer is responsible for carefully reviewing the final proof before approving production.

Approval constitutes authorization for FIFE to manufacture the products substantially in accordance with the approved proof, subject to reasonable production tolerances.

Customer-Supplied Content

Customers may submit names, logos, photographs, slogans, graphics, course references or other material ("Customer Content").

By submitting Customer Content, you represent that you own the necessary rights or have appropriate permission to provide it to FIFE and authorize its use for your order.

FIFE reserves the right to decline material that we reasonably believe may infringe another person's rights or otherwise cannot appropriately be used.

Intellectual Property

The FIFE name, FIFE wordmark, FIFE monogram, brand identity, original graphics, website content and other original FIFE intellectual property remain the property of FIFE or its applicable licensors.

Purchasing a Trip Collection does not transfer ownership of the FIFE brand or its underlying intellectual property.

Unless otherwise agreed in writing, FIFE may reuse its general production methods, layouts, design systems, templates, know-how and non-customer-specific creative concepts.

Production Times

Production timelines provided by FIFE are estimates unless FIFE expressly guarantees a particular delivery date in writing.

Production may be affected by supplier inventory, decoration capacity, shipping carriers, customer approval delays and circumstances outside FIFE's reasonable control.

Customers with fixed travel dates should place orders sufficiently in advance.

Changes and Cancellations

Contact FIFE immediately if you need to modify an order.

Changes requested before production may be possible.

Once garments have been ordered, decorated, personalized or otherwise entered production, changes or cancellations may be restricted and costs already incurred may be non-refundable, subject to applicable law.

Any additional costs resulting from customer-requested changes will be communicated where applicable.

Returns and Problems

Custom and personalized products are subject to the FIFE Custom Order & Returns Policy below.

Nothing in these Terms is intended to eliminate rights or remedies that cannot lawfully be excluded under applicable consumer-protection legislation.

FIFE / Document 15

Website Availability

We try to keep our website accurate and available but cannot guarantee uninterrupted or error-free operation.

We may modify, suspend or discontinue website features where reasonably necessary.

FIFE / Document 16

Limitation of Liability

To the maximum extent permitted by applicable law, FIFE will not be responsible for indirect, incidental, special or consequential losses arising from an order or use of the website.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

FIFE / Document 17

Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without limiting any mandatory rights a consumer may have under applicable law.

Changes to These Terms

FIFE may update these Terms from time to time.

The version applicable to an accepted order will generally be the version in effect when that order was accepted, except where a change is required by law or agreed to by the parties.
